 Representative Terms and Conditions

1. Agreement to Terms

These Terms of Use constitute a legally binding agreement between you (“you”), whether personally or on behalf of an entity, and Document Systems Direct LLC, doing business as Welders Log ("Welders Log", “we”, “us”, or “our”), concerning your access to and use of https://www.welderslog.com and any related media, mobile website, or applications (collectively, the “Site”). By accessing the Site, you agree to be bound by these Terms of Use. If you do not agree, you are prohibited from using the Site and must discontinue use immediately. Supplemental terms and conditions posted on the Site are incorporated by reference. We reserve the right to modify these Terms at any time; continued use constitutes acceptance of changes. The Site is intended for users who are at least 18 years old. Persons under 18 may not use or register for the Site.

2. Intellectual Property Rights

Unless indicated otherwise, the Site and all Content (including source code, databases, functionality, software, designs, audio, video, text, photographs, and graphics) and all trademarks, service marks, and logos (the “Marks”) are owned, controlled, or licensed by us and are protected by U.S. and international intellectual property laws. Content and Marks are provided “AS IS” for personal use only. You may not copy, reproduce, republish, distribute, or exploit the Content or Marks without our prior written permission. Eligible users are granted a limited license to access and use the Site and download or print Content for personal, non-commercial use. All other rights are reserved.

3. User Representations

By using the Site, you represent that you:

  1. Have legal capacity and agree to comply with these Terms.

  2. Are not a minor in your jurisdiction.

  3. Will not access the Site through automated or non-human means.

  4. Will not use the Site for illegal purposes.

  5. Will comply with applicable laws.

Providing false, inaccurate, or incomplete information may result in suspension or termination of your account.

4. Fees and Payment

You may be required to pay fees to access some services. You agree to provide accurate payment information and authorize us to charge your payment method. Recurring charges will continue until you cancel. We reserve the right to correct pricing errors and refuse orders.

5. Cancellation

Subscriptions renew automatically unless canceled. To cancel, email Support@WeldersLog.com at least 45 days before the next billing cycle. All purchases are non-refundable. We may update fees from time to time.

6. Software

Any software provided is governed by its EULA or, if none, by a non-exclusive, revocable license for personal use only. Software is provided “AS IS” without warranty. You may not redistribute software except as permitted.

7. Prohibited Activities

You may not use the Site in unauthorized ways, including but not limited to:

  • Scraping, data mining, or creating derivative databases.

  • Misleading or defrauding users.

  • Circumventing security measures.

  • Harassing or harming others.

  • Uploading viruses or malicious code.

  • Automating interactions or impersonating others.

  • Collecting user data for unsolicited communications.

  • Competing with Welders Log using the Site or Content.

Violations may result in termination of access.

8. User Generated Contributions

While the Site may allow contributions, you represent that:

  • You own or have rights to all submitted content.

  • Contributions do not violate rights of others.

  • Contributions are not false, obscene, or unlawful.

9. Contribution License

You retain ownership of your Contributions. By submitting feedback, you grant us rights to use it without compensation. You release Welders Log from liability for your Contributions.

10. Submissions

Any questions, suggestions, or other submissions are non-confidential and become our property. We may use and disseminate them freely.

11. U.S. Government Rights

Services acquired by U.S. Government agencies are subject to FAR and DFARS clauses as applicable.

12. Site Management

We may monitor, restrict, or remove content, manage Site operations, and take legal action to protect our rights.

13. Privacy Policy

By using the Site, you agree to our Privacy Policy: https://www.welderslog.com/privacy-policy/. Data may be transferred to and processed in the United States.

14. Term and Termination

These Terms remain in effect while you use the Site. We may deny access, terminate accounts, or delete content at our discretion without notice. You may not circumvent termination restrictions.

15. Modifications and Interruptions

We may modify, suspend, or discontinue the Site at any time. We are not liable for interruptions, downtime, or discontinuation.

16. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

17. Dispute Resolution

Disputes must first be negotiated informally for 30 days. If unresolved, binding arbitration under AAA rules applies. Certain disputes (IP rights, theft, privacy violations, injunctive relief) are exempt.

18. Corrections

We may correct errors or update information on the Site at any time without notice.

19. Disclaimer

The Site is provided “AS IS” and “AS AVAILABLE”. We disclaim all warranties, express or implied, including merchantability, fitness, or non-infringement. We are not responsible for errors, interruptions, viruses, or third-party content.

20. Limitations of Liability

We and our affiliates are not liable for direct, indirect, incidental, or punitive damages. Liability is limited to the amount paid by you in the three months prior to the claim. Some state laws may limit these disclaimers.

21. Indemnification

You agree to indemnify us for losses, claims, or damages arising from your use of the Site or violation of these Terms.

22. User Data

You are responsible for data transmitted to the Site. We are not liable for loss or corruption of such data.

23. Electronic Communications

Electronic communications and signatures are valid and binding. You consent to receive notices electronically.

24. California Users

California residents may contact the California Department of Consumer Affairs for unresolved complaints.

25. Miscellaneous

These Terms constitute the entire agreement. Rights not exercised are not waived. Terms are severable. No partnership or employment is created. Software is hosted on Microsoft Azure under its SLA: https://azure.microsoft.com/en-us/support/legal/sla/
